Hello everybody,

i found another really interresting article. It is about a man who was fired from his job because of his age or an accident?? Yes i formulated this as a question as I want you to read the article and tell me afterwards what you think about it.

  1. In this case I would say you can definitely speak of being fired because of age reasons. If the HR director could have stated incidents that happened before the accident (like constantly napping during working time, unappropriate behavior etc) you might have a legitimate reason for a normal dismissal, but all the reasons mentioned were connected to the accident.

  2. I have to agree with Hella since it seems obvious that the company wanted to "get rid" of Logan as he had been considered as too old many times before. In my opinion, there has to be a certain age, where people shouldn´t be working anymore, of course it always depends on the individuals, but when getting older, people might experience a loss of skills and concentration and therefore they are not able to do their job properly anymore.

  3. Thank you for the article, Steffie! I go along with the opinions of Hella and Tanja as it also seems to me that the accident was simply a "great" opportunity to make the 76 old leave the company. However, one point keeps me wondering as I ask myself why they at all hired the old man in the beginning? Probably it was just out of a feeling of obligation since he worked for the former firm. In my opinion, this situation could have been avoided by simply not having prolonged his contract/hired him again.

  4. I also think that the accident was only an excuse to finally fire him. Just as Tanja, I was also wondering why he still worked anyway in such a position at his age, especially for a 24 hours shifts. The HR director did not give credible reasons to justify the dismissal. If there would have been other incidents recorded, the outcome could be warrantable, but in this case, the employer faced age discrimination.

Sometimes you only need a trigger to end something and so did the company when they (finally?) decided to fire him. is it always the right way of finding a solution? as they were not satisfied with his work all the time, which is probably not very advantageous for the company, they should have chosen another path than the one they followed.

  6. I also think that the company was only looking for a reason to fire him and the arguments of the HR director just look like excuses.
    I also agree with Marlene that the company should have found another way to deal with the fact that they were not satisfied with his work. And I don't understand why they hired him in the first place when he was already 70 back then. Did he do a better job when the company was operating under it's old name?

  7. Hm, interesting discussions going on here! And I would just like to discuss this one with you in, let's say 30 years? ;)
    Anyway, I also see that the termination at the end was age related! But I do not see why a 76 year old cannot work anymore (I think most people only get really old when they do not work anymore). What I do not understand how one can work productively a 24 hour shift, no one can really do that (apart from doctors in our health care systems), also young people would make mistakes, that why this luckily would be illegal on our side of the Atlantic!
